Seller – User who publishes an Advertisement on the Website and carries out Transactions with the Buyer.
Transaction – any contract concluded between Users or the Advertiser and the Visitor in relation to properties or properties.
Advertiser/User – natural person, legal person or organizational entity without legal personality, with full legal capacity to promote and/or conclude transactions relating to the Product that they intend to advertise, in accordance with Portuguese law, and who uses the Service after logging into the Account/logging in.
Professional Advertiser – User of the Service who acts as a trader or professional, who is a natural person, legal person or organizational entity without legal personality, to which the law grants legal capacity to, in its own name, carry out commercial or professional activities and use the Imounique services on the Website, within the scope of your commercial or professional activity.
Contracting through this platform is electronic contracting, in accordance with the provisions of articles 26 of Decree-Law no. 7/2004, of January 7 and 3 of Decree-Law no. 290-D/99 , of August 2nd and complies with the provisions of Decree-Law no. 24/2014, of February 14th. If you do not agree to the conclusion of the contract by electronic means, you should not use the Website or the Application. The Terms and conditions for using the Website, including the rules for Registration, publishing Ads and purchasing Paid Services, as well as issues related to the payment and complaint procedure, are set out in the Terms and Conditions.

The provision of the Imounique service is dependent on full acceptance of these conditions, so any user who does not agree or does not commit to behaving in accordance with these conditions will not be able to use the said service.
Any change to these Terms and Conditions will be communicated on a durable medium to users within a reasonable period of time (advance notice) equal to or not less than 15 days, unless another legal period is applicable.
Visitors may only use the limited functions of the Service as set out in these Terms and Conditions, respecting the law and principles of integrity.

The use of the Website and Imounique’s designations, including characteristic graphic elements, without Imounique’s consent is also prohibited.
Nothing in these Terms and Conditions shall constitute a consent to the use of Imounique’s rights or the rights of third parties mentioned or shall be deemed a waiver of such rights.
Imounique is not a party to the Transaction, therefore:
Imounique is not responsible for the behavior of advertisers, or items and services advertised by them for sale as described in their advertisements. By violating the rules in force at Imounique in a given advertisement, the user will assume any and all liability resulting in damages or losses to any entity, natural or legal person, with Imounique being exempt from any type of resulting liability.
The legality of access to the service depends on the fact that no type of contracts, onerous or not, are signed under the authority of Imounique, meaning that access to the service is permitted to users, regardless of the party’s possession of full legal capacity. of these. Not being a transaction mediator, Imounique is not responsible for any eventuality resulting from users’ lack of legal capacity.
Imounique is not responsible for any damage that occurs as a result of a transaction, or inappropriate behavior of one of the parties to the transaction.

Highlights will only be released during the period mentioned in the Plans. The placement of advertisements with paid highlights is dependent on prepayment, and under the terms defined in our Tariff, which constitutes an integral part of these Terms and Conditions of Service.
Advertisements must comply with the conditions indicated in the “Content and Advertisements” section of the Terms and Conditions of Service;
Content and Advertisements: The Advertisement is prepared by the Advertiser, and its content is the sole responsibility of the respective Advertiser. The content of each Advertisement must comply with the requirements established in the Terms and Conditions, be truthful, contain no ambiguities and satisfy the technical requirements specified by Imounique. The User may determine the content of the Advertisement within the limits of the law and in accordance with Imounique’s criteria. The advertisement must be written in Portuguese or English and must not contain words usually considered vulgar or offensive, dubious or false information. The content of the advertisement must contain a clear, precise and complete description of the Article, including truthful and non-misleading information about its characteristics. If the Advertiser chooses to place photographs, we ensure that they can place between 8 and 16 photographs (depending on the plan subscription) per ad, in JPG, PNG or GIF format, with 16 photographs being the maximum number of photographs for the categories.
In cases where the Advertisement contains hyperlinks to other websites or applications or information provided by third parties, these are included on the Website for the information of the Advertiser and the Visitor only. Such hyperlinks and information are not endorsed by us and we have no control over the content of such sites, applications, materials or information. You should always check the terms of use and privacy policies of the sites you access from the Site or Application before using them.
Plans: Advertising and service packages named Basic, Premium and BitCoin are considered. Each one determines certain limitations on advertisements or services, so you should consult the Plans section/menu. It is possible to purchase an Advertising package using the corresponding form available on the Website. The purchase of an Ad package results in the User being assigned the status of Agent (Basic plan) and Top Agent (premium and bitcoin plan). Activation of a Paid Ad on the Service will take place when payment has been credited to Imounique’s account.
Payments: Payments for the Service and/or Plans can be made through the Paypal®, MB WAY system or through a bitcoin or USDT crypto wallet.
Illegal Actions: If a credible message is received (through an abuse report or any other means) that content sent or published using the Service functionality is illegal or violates the provisions of the Terms and Conditions, Imounique may:
- immediately block the content in question, including in particular the Advertisement and related Promotional Services.
- In case of blocking, the content will not be visible or available to people using the Service or on a given User’s Account panel;
- take investigative measures to determine the circumstances of the case, acting proportionately and reasonably, including, for example, contacting the complainant, the content provider, the competent authorities or an external consultant;
If the illegal action is considered unjustified or the Agent does not object within 7 days after obtaining the specified information, the blocked content will be irrevocably removed from the Service;
If the illegal action is considered unjustified, Imounique reserves the right to cancel the agent’s plan and account without the agent being entitled to any refund of the amounts paid under the subscribed plan.
Imounique may remove the Advertisement or block the account if there is a suspicion that acts that threaten the safety of other Users of the Service may occur through the Advertisement or the Account and, also, in the event that the Advertisement negatively affects the good name of the Imounique or otherwise harm Imounique.
In case of serious violation of the law using the Service, as well as repeated serious violation of the provisions of the Terms and Conditions, in particular in case of repeated attempts to publish or disseminate illegal content by a User or several Users acting jointly or in agreement, including the use of multiple Accounts, Imounique may, in accordance with the principles of proportionality and respect for contractual freedom and private autonomy, temporarily or permanently suspend or block the Account or Accounts, which will be equivalent to a temporary suspension of the provision of the services to the User.
Required content of certain ads
The advertisement must be in Portuguese or English and must be legible for other users, without violating the generally applicable provisions of law, namely:
- swear words, obscene and pornographic content or encourage the spread of hatred, racism, xenophobia and conflicts between nations;
- website addresses or hyperlinks to other websites
- the advertisement must contain quality images not exceeding 1mb in order to respect the identity of Imounique and it may be rejected if this criterion is not met.
- the advertisement to contain video, if that is the option, with minimum quality the commonly accepted definition of “HD” in order to respect the identity of Imounique and it may be rejected if this criterion is not met.
